IU's software agreement with Microsoft

Introduction

Microsoft products are industry standards, and support for these products is strong, as is demand for wider use. Because of a constant increase in spending to acquire Microsoft products, in 1998, Indiana University and Microsoft created an arrangement that allowed the university to better leverage its expenditures and Microsoft to better serve its university clients. The original four-year agreement, the Microsoft Enterprise License Agreement (MSELA), signed in 1998 and renewed for an additional year, expired June 30, 2003. In 2003, at no increased cost to IU, IU and the Microsoft Corporation entered into a new three-year agreement, the IU/Microsoft Campus Agreement (CA). In 2006, the CA was renewed for another three years.

The CA provides several key benefits for IU and its students, faculty, and staff. First and foremost, the agreement provides IU with the most popular Microsoft products, including operating systems, desktop productivity tools, and infrastructure server and messaging products. IU distributes these products to all on-campus computers, to students for use at home, and to faculty and staff to use at home provided they also use the products on university-owned resources at work.

Under the CA, IU students, faculty, and staff enjoy the option of either downloading many of Microsoft's most popular software products for free through IUware Online or purchasing software media (one copy of any single Microsoft product) at campus bookstores for a nominal charge.

Also, throughout the life of the CA, IU computer users can upgrade to the latest versions of these Microsoft products.

IU officials believe the CA gives IU a competitive advantage in recruiting and retaining students, as the software tools they most often need (and usually buy on their own) are available to them at no additional cost by attending IU. Having a standard set of tools available to faculty and students gives IU a tremendous advantage in improving the ability of information technology to advance the teaching and learning process.

Eligibility

IU students, faculty members, staff members, departments, or emeritus faculty members may use the products covered by the CA in campus offices, labs, and campus housing on all IU campuses.

Only currently enrolled students may participate in the CA software distribution. However, students who are enrolled for a future semester (e.g., students registered for the fall semester when currently it is summer) may participate in the CA software distribution if they can show proof of registration.

Each student may take home one copy of all licensed software for use on a personally owned computer, whether home is on or off campus.

IU students (full- or part-time) own the license for the current product releases when they leave or graduate from IU. To upgrade to new versions, get release patches, or receive support, students must register ownership with Microsoft. UITS will facilitate this process.

Faculty and staff may use the products on personally owned computers at home as long as they have a copy on their university-owned computer at work. Those who do not use a computer at work may not take the software home. For this reason, Microsoft products may not be distributed to retired staff and retired faculty who do not have emeritus status.

Because faculty and staff home use is dependent upon use at work, faculty and staff (unless they are also IU students) will not have access to the software once they are no longer employed with IU.

Software available through the agreement

All software purchased on media under this agreement is nonrefundable. You cannot trade one version for another; for example, if you purchased Office 2003 and want Office 2007 instead, you must purchase it separately.

  • Operating system: Windows Vista (does not include Ultimate Edition 64-bit version), Windows XP, and all subsequent releases of these and future operating systems throughout the contract; essentially, this will enable users who have Microsoft operating system licenses to always keep current with the latest release from Microsoft. The price for the Windows Vista Ultimate media is $20, and Windows Vista Business is $11 on media. The price for Windows XP media is $11. Operating systems are not available from IUware Online.

    Note: Microsoft's licensing of its operating systems requires you to obtain an operating system when you buy a new computer. Essentially, you may not omit the operating system from any computer you purchase, nor receive credit from Microsoft or its distributors as a result of the IU/Microsoft Campus Agreement. You may, however, upgrade any copy of an older operating system under the Campus Agreement.     When Microsoft releases new versions of Windows, IU students, faculty, and staff will be able to upgrade to these new versions by purchasing the media from a campus bookstore for a nominal fee. Essentially, once you buy a Microsoft operating system, for the duration of the contract you can upgrade it to the latest version with no additional licensing fee. Some operating system updates are also available for download from IUware Online.

  • Web browser: Microsoft Internet Explorer for Mac OS, Mac OS X, and Windows

  • Messaging: Outlook clients for Mac OS and Windows; Exchange Server is available in limited quantity, sufficient for centralized deployment.

  • Web development: Microsoft FrontPage for Windows

  • Developer's tools: Office SharePoint Designer 2007

For departments and information technology staff

The following products are included in the contract for more limited distribution to departments, or to information technology staff who have the experience necessary to use them:

  • Windows PE: An OS kernel useful for loading the OS and troubleshooting

  • Windows XP Tablet PC Edition 2005: The 2005 edition of Windows XP for the Tablet PC

Additional information

IU's contract with Microsoft is written in such a way as to refer to the general category of products (e.g., "desktop suite", which includes a spreadsheet, word processor, presentation software, and database), which covers both new versions and new releases for each line of software. It is unlikely that Microsoft will substantially change the current products in these software lines, but IU is covered by this wording in case that occurs. This holds true for operating system upgrades, as long as Microsoft works within the Windows or Windows NT product suite. UITS believes this will be the case through the period covered by this contract.

If brand new products are released, they will not be covered under the CA. However, if this occurs, IU may work with Microsoft to add the products to the CA.

In the event that Microsoft sells off a given product or product line to another company, the contract contains provisions that allow for the assignment of IU's rights under the contract to other parties. If this happens, IU would establish a similar licensing agreement with the new company for the remainder of the term of the CA.

Products not covered under the announced CA will not be added, unless substantial demand across the institution can be identified and requisite funding to support their addition obtained. However, the remainder of the Microsoft product suite will continue to be available at a discounted price to IU departments (though not individuals) via the Select Pricing program. Contact your campus's purchasing department for details. Funding for any products acquired this way will be the responsibility of the department.
